Publishing Agreement Anthologies

This Publishing Agreement ("Agreement") is entered into between Prohibition Press Ltd. ("Publisher") and the contributor identified during the publication process ("Author").

This Agreement becomes effective only after the Publisher has accepted the Author's Work for publication and both parties have agreed to its publication under these terms.

1. Copyright and Ownership

The Author retains full copyright and ownership of the Work.

The Author grants Prohibition Press Ltd. a non-exclusive, perpetual, worldwide license to publish, reproduce, distribute, display, archive, and promote the Work in connection with Prohibition Press Ltd.'s publishing activities, including but not limited to:

  • Anthologies;

  • Print-on-demand editions;

  • E-books;

  • The Publisher's website;

  • Newsletters;

  • Social media;

  • Promotional materials;

  • Literary magazines;

  • Public readings, festivals, book fairs, and similar events.

Because this license is non-exclusive, the Author remains free to publish or license the Work elsewhere unless another publisher's agreement provides otherwise.

2. Previously Published Works

Prohibition Press Ltd. welcomes original Works that have previously appeared on personal websites, blogs, social media, writing forums, or in the Author's own self-published or traditionally published books, provided the Author retains all necessary publishing rights.

Works previously published in literary journals, anthologies, contests, or other editorial publications may be considered if the Author retains the legal right to republish them and any prior publication was non-exclusive.

3. Editorial Process

Acceptance for publication is entirely at the Publisher's discretion.

Submission of a Work does not guarantee publication.

The Publisher may decline any submission for editorial, artistic, legal, or production reasons.

Minor editorial corrections, including formatting, punctuation, spelling, capitalization, and typographical adjustments, may be made without additional approval.

No substantive edits affecting the meaning, style, tone, or artistic intent of the Work will be made without the Author's approval.

4. Publication and Removal

Once a Work has been published, it may become part of fixed publications, including printed anthologies, digital editions, newsletters, literary magazines, promotional materials, or social media content.

Because these publications have already been distributed, they generally cannot be altered, recalled, or retroactively modified.

If the Author later requests removal of a published Work, Prohibition Press Ltd. will discontinue future publication and promotional use of the Work where reasonably possible, subject to the terms of this Agreement and applicable law.

Requests for removal of personal information remain governed by the Privacy Policy.

5. Compensation

Only Works formally accepted and published by Prohibition Press Ltd. are eligible for compensation under this Agreement.

Compensation, if offered, is based upon Prohibition Press Ltd.'s revenue-sharing model.

Participation in publication without compensation is permitted if both parties agree.

Eligible payments are calculated using the Publisher's monthly revenue-sharing formula after applicable fees and will generally be distributed through Stripe Connect within fifteen (15) days following the end of the applicable month.

The Publisher may modify its revenue-sharing model prospectively by providing reasonable notice to contributors.

6. Payment Processing and Taxes

Payments are processed through Stripe Connect.

Prohibition Press Ltd. does not store sensitive financial information such as bank account numbers or tax forms.

The Publisher retains only the information reasonably necessary to administer contributor payments and comply with legal obligations, including payment history, Stripe Connect Account ID, and legally required tax information.

All payments represent gross amounts before taxes.

The Author is solely responsible for determining, reporting, and paying any taxes arising from payments received under this Agreement.

The Publisher does not withhold taxes unless required by applicable law.

The Publisher is not responsible for payment delays or failures resulting from third-party payment providers, inaccurate information supplied by the Author, regulatory restrictions, or circumstances beyond the Publisher's reasonable control.

7. Author Warranties

The Author represents and warrants that:

  • the Work is original or the Author otherwise possesses all necessary rights to publish it;

  • the Work does not infringe any copyright, trademark, privacy, publicity, or other legal rights;

  • the information supplied to the Publisher is accurate;

  • any material use of artificial intelligence has been disclosed;

  • the primary creative authorship of the Work remains human.

AI-assisted tools used for grammar, spelling, research, or brainstorming are permitted.

Materially AI-generated Works may be declined at the Publisher's discretion.

Simultaneous submissions are welcome. If the Work is accepted elsewhere before publication by Prohibition Press Ltd., the Author agrees to notify the Publisher promptly and withdraw the submission where appropriate.

8. Republication Rights

Because the publishing license granted under this Agreement is non-exclusive, the Author may republish the Work elsewhere at any time, provided doing so does not violate another agreement entered into by the Author.

The Publisher encourages Authors to continue sharing and promoting their Work.

9. Eligibility

The Author must meet the eligibility requirements set forth in the Publisher's Terms of Service.

Authors under eighteen (18) years of age must have the consent of a parent or legal guardian.

10. Governing Law

This Agreement is governed by the laws of the State of Colorado, United States of America.

The parties agree to attempt to resolve disputes through good-faith negotiations before initiating formal proceedings.

If a dispute cannot be resolved informally, it shall be resolved through binding arbitration in Denver, Colorado, under the Commercial Arbitration Rules of the American Arbitration Association, except where prohibited by applicable law.

To the fullest extent permitted by law, both parties waive the right to participate in a jury trial or class-action proceeding arising from this Agreement.

11. Entire Agreement

This Agreement, together with the Publisher's Terms of Service and Privacy Policy where applicable, constitutes the complete agreement between the Author and Prohibition Press Ltd. concerning publication of the Work.

If any provision of this Agreement is determined to be unenforceable, the remaining provisions shall remain in full force and effect.

By accepting publication of the Work, the Author acknowledges that they have read, understood, and agree to the terms of this Publishing Agreement.
